1. Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of the Buy Canadian mobile application, website, and related services (collectively, the “Service”), operated by Senex Technologies Inc. (“Senex,” “we,” “us,” or “our”). By creating an account, accepting these Terms, or using the Service, you agree to be bound by them, to the extent permitted by applicable law. If you do not agree, you must not use the Service. Your use of the Service is also subject to our Privacy Policy.
2. Purpose of the Service
Buy Canadian is an independent information service designed to help consumers discover, research, compare, and evaluate products and businesses associated with Canada. The Service may include product listings, Canadian-origin assessments, Canuck Scale ratings, barcode scanning, product suggestions, shopping lists, household sharing, and subscription-based features. Information is provided for general informational purposes only. Buy Canadian is not a government certification program, product testing laboratory, manufacturer, retailer, or official authority on Canadian product-origin claims. We do not guarantee that products identified through the Service meet any particular legal, regulatory, or commercial definition of “Made in Canada,” “Product of Canada,” or Canadian-owned.
3. Canuck Scale Ratings and Methodology
The Canuck Scale is an independent evaluation system developed by Senex Technologies Inc. to help users understand a product’s relationship to Canada. Ratings may consider Canadian or foreign brand ownership, manufacturing or assembly location, product origin and sourcing, and other information reasonably available at the time of assessment. The information available for individual products may vary, so factors, their relative weighting, and supporting evidence may differ between products. Canuck Scale ratings may involve both factual research and subjective evaluation. A rating represents our assessment based on available information, not a definitive statement about every product sold by a manufacturer or brand. Ratings are not official certifications, legal determinations, or guarantees of Canadian origin. We may revise ratings when new information becomes available, our methodology changes, or errors are identified.
4. Accuracy and Changing Product Information
We make reasonable efforts to provide useful and accurate information. Product information may come from manufacturers, retailers, public sources, users, automated research systems, and other third parties. Ownership, manufacturing locations, sourcing, ingredients, components, availability, and other characteristics may change without notice. We do not guarantee that every listing, classification, description, or rating is accurate, complete, current, or suitable for a particular purchasing decision. Users should independently verify important information through product packaging, manufacturers, retailers, and other authoritative sources before purchasing. Purchasing decisions remain your responsibility.
5. Automated and AI-Assisted Information
Certain features may use automated processes or artificial intelligence to identify products, research information, suggest classifications, or assist in generating descriptions and assessments. Automated information may contain errors, omissions, outdated information, or incorrect conclusions. AI-generated or AI-assisted information should not be considered independently verified unless expressly identified as such. We may review, correct, replace, or remove automated information, subject to applicable law.
6. Independent Ratings, Opinions, and No Affiliation
Buy Canadian operates independently of the manufacturers, retailers, and brands appearing in the Service unless an affiliation is expressly disclosed. The inclusion of a product, business, brand name, logo, or trademark does not imply sponsorship, approval, endorsement, partnership, or affiliation. Canuck Scale ratings and other evaluations represent our independent assessments and opinions. We aim to distinguish factual statements from evaluative judgments and do not intend to misrepresent any manufacturer, brand, business, or product.
7. Corrections, Disputes, and Rating Reviews
Manufacturers, brand owners, retailers, and other affected parties may request a review of information or ratings they believe are inaccurate. Requests should identify the product, brand, or listing; the disputed statement or rating; the reason for the dispute; and supporting documentation or verifiable information, where available. Requests may be submitted through the contact information provided in the app or on our website. We will consider credible correction requests in good faith and may investigate, revise, clarify, or remove information when appropriate. A request does not guarantee a particular outcome, removal, or revised rating. We reserve the right to maintain independent assessments supported by available evidence and lawful opinion.
8. User Accounts and Security
Some features require a registered account. You agree to provide accurate account information and maintain the confidentiality of your login credentials. You are responsible for activity through your account to the extent permitted by applicable law. Notify us if you become aware of unauthorized account access. We may restrict, suspend, or terminate accounts involved in fraud, abuse, unauthorized access, or violations of these Terms, subject to applicable law. Users may request account deletion through available account-management features or by contacting us. Personal information is handled according to our Privacy Policy and applicable law.
9. Household and Shared Features
The Service may allow users to invite household members and share shopping lists, saved products, or other information. Information shared with a household may be accessible to other authorized household members. Invite only individuals whom you are authorized to invite, and avoid sharing information that you do not have permission to disclose. You are responsible for managing invitations and memberships through available controls. We do not guarantee that information already viewed, copied, or independently retained by another household member can be recovered or deleted when sharing permissions change.
10. User Submissions and Content
Users may suggest products, submit information, report inaccuracies, or otherwise contribute content. Do not submit content that is knowingly false, misleading, defamatory, unlawful, infringing, or violates others’ rights. You represent that you have the necessary rights or permissions to submit your content. You retain ownership of your original content. By submitting content, you grant Senex Technologies Inc. a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, adapt, and use that content as reasonably necessary to operate, improve, and provide the Service, subject to applicable law and our Privacy Policy. We may review, moderate, correct, reject, or remove submissions that violate these Terms or are unsuitable for the Service. User-submitted information is not guaranteed accurate or independently verified.
11. Free and Pro Subscription Features
Buy Canadian may provide both free and paid features. Certain functionality may require an active Buy Canadian Pro subscription. Pro subscriptions are offered through the Google Play Store and Apple App Store. Subscription prices, billing periods, introductory offers, trials, and renewal terms are displayed during purchase. Where a subscription automatically renews, renewal and billing occur according to the terms disclosed at purchase and the applicable app store’s policies. Subscriptions are managed through the store account used to purchase them. Cancellation: Users may cancel through their Google Play or Apple subscription settings. Uninstalling the app does not automatically cancel a subscription. Cancellation generally prevents future renewals, while access may continue until the end of the paid period, subject to store terms and consumer rights. Refunds: Refund requests are handled according to applicable Google Play or Apple policies and mandatory consumer-protection laws. We may modify Pro features or offerings, subject to applicable law, required notices, and applicable refund or cancellation rights. Nothing in these Terms limits subscription-related rights that cannot lawfully be excluded.
12. Acceptable Use
You agree not to attempt unauthorized access to accounts, systems, or data; interfere with operation or security; scrape or redistribute protected content without authorization except where permitted by law; submit fraudulent, misleading, unlawful, or infringing information; circumvent subscription restrictions; impersonate others; or violate applicable laws or others’ rights. We may take reasonable action to protect the Service and users, including restricting access or removing content, subject to applicable law.
13. Intellectual Property
The Buy Canadian name, Canuck Scale, application design, software, original text, graphics, databases, and other original materials are owned by Senex Technologies Inc. or used under applicable rights or licences. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for lawful personal purposes, subject to these Terms and applicable law. Third-party product names, brand names, logos, images, and trademarks remain the property of their respective owners. Their appearance does not transfer ownership or imply endorsement. Nothing in these Terms restricts rights or uses expressly permitted by applicable law.
14. Third-Party Products, Retailers, and Services
The Service may display information about or link to third-party manufacturers, retailers, websites, and services. We do not control their products, prices, inventory, shipping, warranties, returns, or business practices. Purchases and transactions with third parties are governed by those parties’ terms and policies. We are not the seller of products merely because they appear in Buy Canadian. Review third-party information before entering into transactions.
15. Service Availability and Changes
We may update, improve, modify, suspend, or discontinue features. We do not guarantee uninterrupted or error-free availability. Interruptions may occur because of maintenance, technical issues, third-party outages, or circumstances beyond our reasonable control. Where changes materially affect paid services or legal rights, we will provide any notice, remedy, or other protection required by applicable law.
16. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis. We make no guarantee that the Service, classifications, ratings, recommendations, or other information will be uninterrupted, error-free, complete, current, or suitable for a particular purpose. Product-origin assessments and Canuck Scale ratings may contain errors or reflect subjective judgments. Nothing in these Terms excludes any warranty, condition, representation, right, or remedy that cannot lawfully be excluded.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Senex Technologies Inc. shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, business opportunities, or data, arising from or related to use of or inability to use the Service; reliance on product listings, origin information, recommendations, or ratings; inaccurate or outdated third-party information; transactions with third parties; interruptions or technical failures; or user-submitted content or unauthorized account use. These limitations apply only to the extent permitted by applicable law. Nothing limits or excludes liability for fraud, wilful misconduct, or any other liability that cannot lawfully be limited or excluded, or restricts mandatory consumer-protection rights.
18. Privacy and Personal Information
Use of the Service may involve collection, use, disclosure, and storage of personal information. Our Privacy Policy explains our practices, including third-party technology and service providers. Personal information is handled as described in our Privacy Policy, subject to applicable privacy laws and consent requirements. These Terms do not replace any consent or notice required by law.
19. Changes to These Terms
We may update these Terms to reflect changes in the Service, laws, or business practices. Updated Terms will display a revised effective date. Where required by law, we will provide advance notice or obtain consent before material changes take effect. Continued use after properly notified changes become effective may constitute acceptance to the extent permitted by applicable law. If you disagree, you may discontinue using the Service and exercise applicable account, subscription, or cancellation rights.
20. Governing Law and Disputes
These Terms are governed by applicable laws of Ontario and the federal laws of Canada, without limiting mandatory consumer-protection laws that apply in another jurisdiction. Before formal legal proceedings, users are encouraged, but not required, to contact us to seek informal resolution. Nothing prevents users from exercising statutory rights, complaining to regulators, or accessing courts or other remedies available under applicable law.
21. Severability
If any provision is invalid or unenforceable, the remaining provisions continue in effect to the extent permitted by law.
